Hazing

Be it enacted by the Senate and House of Repre-sentatives in General Court assem-bled, and by the au-thority of the same, as follows:

Chapter 269 of the General Laws is here-by amended by adding the following three sec-tions:

Section 17. Whoever is a principal orga-niz-er or participant in the crime of haz-ing as de-fined herein shall be punished by a fine of not more than one thousand dollars or by im-pris-on-ment in a house of correction for not more than one hundred days, or by both such fine and im-pris-on-ment.

The term "hazing" as used in this sec-tion and in sections eighteen an nineteen, shall mean any con-duct or method of initiation into any student orga-nization, whether on public or pri-vate property, which willfully or recklessly endan-gers the physical or men-tal health of any student or other per-son. Such conduct shall include whip-ping, beating, brand-ing, forced calis-thenics, exposure to the weather, forced consumption of any food, li-quor, bever-age, drug or other substance, or any other brutal treat-ment or forced physi-cal activity which is like-ly to adversely affect the physical health or safety of any such student or other person, or which subjects such student or other per-son to extreme mental stress, including extended de-privation of sleep or rest or extended isola-tion.

Section 18. Whoever knows that another person is the victim of hazing as defined in section seventeen and is at the scene of such crime shall, to the extent that such son can do so without danger or peril to himself or others, report such a crime to an appropri-ate law en-forcement official as soon as reasonably prac-tica-ble. Whoever fails to report such crime shall be punished by a fine of not more than five hundred dollars.

Section 19. Each sec-ondary school and each public and pri-vate school or col-lege shall is-sue to every group or orga-nization under its author-ity or operat-ing on or in conjunc-tion with its campus or school, and to every member, plebe, pledgee or applicant for membership in such group or organi-zation, a copy of this sec-tion and sec-tions seventeen and eighteen. An officer of each such group or organization, and each individu-al re-ceiving a copy of said sec-tions seven-teen and eighteen shall sign an acknowledgment stating that such group, or-ga-ni-zation or indi-vidual has received a copy of said sections seventeen and eigh-teen.

Each secondary school and each public or pri-vate school or college shall file, at least annu-ally, a report with the re-gents of higher edu-cation and in the case of second-ary schools, the board of education, certifying that such institu-tion has complied with the provisions of this sec-tion and also cer-tifying that said school had adopted a disciplinary policy with regards to the organizers and par-ticipants of hazing. The board of regents and in the case of secondary schools, the board of educa-tion shall promul-gate regula-tions governing the con-tent and fre-quency of such re-ports, and shall forthwith report to the attor-ney general any such institu-tion which fails to make such re-port.
